1. Agreement to Terms

Welcome to Personomist, the science-based platform helping people to understand themselves and the roles they fit in. These Terms of Use, together with our Privacy Policy, govern your use of our platform. By creating an account or using our services, you agree to these terms.

Please take a few minutes to read them carefully. If you don't agree, please don't use Personomist.

2. Eligibility and Important Limitations

2.1 Age Requirements

15-17 year olds: You may use the Service and provide your own consent under article 8 of the GDPR and the laws of the European Union member states. However, please note that the feedback algorithms are scientifically designed and validated primarily for adults aged 18 and older, and may be less accurate for younger users.

Under 15: The Service is not available to individuals under 15 years of age, and we do not knowingly collect data from anyone under 15.

2.2 Not a Medical or Diagnostic Tool

Personomist is designed for enhanced self-understanding and personal development only. It is NOT a medical, psychological, or psychiatric diagnosis or assessment tool, and does not provide medical or mental health advice. It can be used to enhance counselling or other psychological assessment-based services, but only alongside other tools, and it should not be relied on for any consequential decisions.

What We Provide: Feedback about normal personality traits based on research with non-clinical populations. Personomist's results describe general psychological characteristics within typical human variation - not pathology or illness.

What We Don't Provide: We do not diagnose or treat any medical or mental health conditions (including but not limited to depression, anxiety, ADHD, personality disorders, or autism spectrum conditions). Also, we do not provide career counselling.

When to Seek Help: If you're experiencing mental health concerns, emotional distress, or suicidal thoughts, contact a qualified mental health professional immediately. Do not use Personomist results to diagnose yourself or others, or to delay professional care. If you would like to discuss the results for making other consequential decisions, such as career or relationship decisions, please consult with relevant professionals.

For Professionals: Professionals such as psychologists, occupational counsellors, and others may use Personomist as one tool among many, but only within their scope of practice and never as the sole basis for recommendations or decisions.

3. Description of Service

Personomist is a digital platform that provides:

• Personality Assessments: Science-based questionnaires that generate personalized feedback about users' psychological traits; users can use the platform for multiple questionnaires and complete each questionnaire multiple times for more reliable results and/or to track changes
• Multi-Source Feedback: The ability to invite acquaintances to provide assessments, creating a more comprehensive, reliable, and valid personality profile (identity and reputation)
• Predictive Insights: Data-driven predictions about personality matching career and leisure options, archetypal social roles, stress resilience, leadership potential, and other life domains
• Comparison Tools: Ability to form groups with a partner, friends, colleagues, or team members and compare personality profiles and role matches
• Organization Tools: Features for professionals to use assessments in their work (counselling, recruitment, coaching), including a possibility to describe personality profiles corresponding to specific roles (e.g., a suitable candidate), invite users to compare their traits with the described profile, and share the results.

The questionnaires and feedback are designed and developed by qualified psychology researchers based on validated psychometric tools and extensive research based on tens of thousands of participants.

4. Account Registration and Security

4.1 Account Creation

• You may create an account using Google authentication or other methods, such as your own email address (we use passwordless registration and do not save users' passwords)
• For accurate results, you must provide accurate and complete information about your basic demographic information (age, gender), and are optionally invited to provide information on your education and occupation for further development of the platform.
• You are responsible for maintaining the confidentiality of your account credentials

4.2 Account Responsibility

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized use
• We reserve the right to suspend or terminate accounts that violate the terms described in this document

4.3 Inactive Accounts

Accounts inactive for 5 years may be deleted after a reminder notification.

5. Use of the Service

5.1 Permitted Uses

You may use Personomist to:

• Complete personality assessments about yourself
• Invite acquaintances to provide feedback about you
• View your assessment results
• Share results with professionals or in group comparisons (with appropriate consents from all group members)
• Use organizational features (invite users to share their results, describe personality traits desirable for a specific role) if you represent a qualifying organization

5.2 Prohibited Uses

You may NOT:

• Provide false information or impersonate others
• Attempt to disrupt the service
• Use automated software to access or extract data from the service
• Use software (including artificial intelligence tools or other bots) to fill in questionnaires about yourself or others
• Use the service for unlawful purposes or to harm others
• Directly or indirectly coerce others to share their results
• Use results to discriminate in employment or other decisions in violation of applicable law

5.3 Professional Use Standards

Organizations and professionals using Personomist must:

• Use assessment results only for legitimate professional purposes
• Obtain appropriate consent before viewing user results
• Make sure those invited to share their results do not feel uncomfortable or compelled to do so
• Maintain confidentiality of shared information
• Comply with employment and discrimination laws when using results for hiring

6. Assessment Completion and Acquaintance Feedback

6.1 Self-Assessments

• You must complete all questionnaire items to receive feedback based on this questionnaire
• We recommend users completing assessments multiple times on different days for more reliable results; as in any form of assessment, multiple assessments correct for measurement errors

6.2 Acquaintance Assessments

• You may invite acquaintances to assess you via email or a shared link
• Acquaintances do not need accounts
• Acquaintances provide basic information (age, gender, relationship type, length of acquaintance)
• You will only see aggregated results after at least two acquaintances have completed the questionnaire
• Individual responses cannot be linked to specific acquaintances
• We recommend inviting acquaintances you trust and feel comfortable asking and accepting feedback from

6.3 Accuracy and Limitations

• Assessment results are based on statistical models and scientific research; the results are always probabilistic predictions about your traits and roles that may match these traits; the results are not established facts
• Thus, the results provide insights but should be interpreted as general tendencies that are likely to apply "on average" (in some circumstances and some of the time) but not in all circumstances and at every occasion
• Professional decisions should not be based solely on Personomist results

7. Sharing and Consent

7.1 Group Comparisons

• You may create groups and invite others to share results
• By accepting membership, group members can view the results of other members and their results are seen by other group members
• You can leave groups at any time, removing your data from group comparisons
• Group creators can delete groups, ending access for all members

7.2 Sharing with Organizations

• You control whether to share your results with professionals/organizations
• Sharing requires your explicit consent for each sharing request and each type of feedback
• The default sharing period is 30 days, but you can revoke access anytime

8. Research and Development

8.1 Consent for Development

By using Personomist, you consent to the use of your anonymized data for:

• Improving feedback algorithms and predictive models
• Developing new features and services

8.2 Data Handling

• Weekly anonymized backups are created for development purposes
• Development data extracted from the Personomist database cannot be linked back to your identity

9. Intellectual Property

9.1 Ownership

All content, algorithms, questionnaires, and functionality of Personomist are owned by University of Tartu and protected by intellectual property laws.

9.2 Your License

Individual Users: You may use the Service for personal, non-commercial purposes only. You may not copy, modify, distribute, reverse engineer, or otherwise exploit any part of the Service beyond your authorized use.

Professional/Organizational Users: If you subscribe to professional or organizational features, you may use the Service for your professional practice according to your subscription terms, but may not:

• Resell or sublicense access to third parties
• Copy, modify, or reverse engineer the Service
• Use the Service to create competing products

9.3 Your Data

You retain ownership of information you provide. By using the Service, you grant us permission to:

• Use your data to provide and improve the Service
• Create anonymized/pseudonymized copies for development
• Display your results to you and parties you authorize

10. Third-Party Services

The Service uses third-party services (such as Google authentication, Stripe for payments). We are not responsible for their content, practices, or availability. Their own terms and privacy policies apply.

11. Disclaimers and Limitations

11.1 "As Is" Provision

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties. We do not guarantee accuracy, completeness, or uninterrupted service. Your use is at your own risk.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

12. Indemnification

You agree to indemnify University of Tartu and Personomist from any claims arising from your violation of these Terms, your use of the Service, or your violation of others' rights.

13. Termination

13.1 By You

You may delete your account at any time through your account settings.

13.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Pose a security or legal risk
• Fail to pay applicable fees

13.3 Effect of Termination

• Your access will be revoked
• Personal data will be handled according to our Privacy Policy
• Anonymized data will be retained for development
• Provisions regarding intellectual property, disclaimers, and limitations survive termination

14. Data Processing Agreement

14.1 GDPR Compliance

We process your data in accordance with GDPR and Estonian law. See our Privacy Policy for details.

14.2 Data Controller

University of Tartu is the data controller for Personomist. Contact: katlin@personomist.com.

14.3 Your Rights

You have rights to access, rectify, erase, restrict, port, and object to processing of your data. See our Privacy Policy.

15. Modifications to Terms

15.1 Changes

We may modify these Terms at any time. We will notify you of material changes via:

• Email to your registered address
• Prominent notice on the platform
• Update to "Last Updated" date

15.2 Acceptance

Continued use after changes constitutes acceptance of modified Terms. If you don't agree, stop using the service and delete your account.

16. Dispute Resolution

These Terms are governed by Estonian and European Union law. Disputes shall be resolved in Estonian courts. We encourage you to contact us first to resolve issues informally.

17. General Provisions

These Terms and our Privacy Policy constitute the entire agreement between you and Personomist. If any provision is invalid, the remaining provisions continue in effect. We may assign these Terms as part of restructuring or transfer; you may not assign them without our consent.

• You consent to the processing of your data as described in our Privacy Policy
